By installing this product, you are agreeing to be bound by the terms of this license. This Agreement constitutes the complete agreement between you and Michal Kowalski (MK), the author of ExifPro (Program). If you do not agree to the terms of this Agreement, do not complete this installation.
1. License: MK grants you (Licensee) a non-exclusive right to use this copy of the Program. You may use this product on a single computer. For your convenience, you may install this licensed copy of the product on no more than three (3) computers (e.g., home, office, laptop) for your exclusive use or that of immediate family members who live in the same household as the licensee, provided that no two of those computers shall ever operate the software at the same time.
2. Ownership: Although Licensee is owner of any physical media on which Program is recorded or fixed, MK remains the sole owner of any Program provided and all copies made thereof.
3. Copy Restrictions: The Program and the accompanying materials are copyrighted of MK. Unauthorized copying of Program and all accompanying material is expressly forbidden. Licensee may be held legally responsible for any copyright infringement which is caused or encouraged by failure to abide by the terms of this License.
4. Transfer Restrictions: The License is personal to you. Licensee shall not copy, disclose, use, license, sell or otherwise transfer or use all or any part of the Program or accompanying materials without the prior written permission of MK.
5. Modifications: Licensee agrees not to modify, adapt, disassemble, merge or reverse engineer the Products acquired with this License.
6. Termination: This Agreement is effective until terminated. This Agreement will terminate without notice from the licensor if you fail to comply with any provision contained herein. Upon termination, you shall destroy the written materials, and all original and backup copies of the software program, in part, and in whole, including modified copies, if any.
DISCLAIMER AND LIMITED WARRANTY
THE PRODUCTS ARE LICENSED TO LICENSEE "AS IS" AND ALL WARRANTIES OF ANY KIND EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, ARE HEREBY EXCLUDED. MK SHALL HAVE NO LIABILITY WITH RESPECT TO ITS OBLIGATIONS UNDER THIS AGREEMENT FOR CONSEQUENTIAL, EXEMPLARY OR INCIDENTAL DAMAGES EVEN IF IT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL THE AUTHOR BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES (INCLUDING, BUT NOT LIMITED TO, PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES; LOSS OF USE, DATA, OR PROFITS; OR BUSINESS INTERRUPTION)
This Agreement is governed by the laws of California.
